1. COMPANY ORGANISING THE PROMOTIONAL CAMPAIGN
The company BLUE FACTORY TEAM S.L.U. with registered office at C/ Nicolás Copérnico 4, Elche, Spain and identification number B-53789822 is organising a prize draw for 5 Mondraker luggage kits (hereinafter, "the Promotion") for promotional purposes in Europe, USA, Canada, Central America, South America and Oceania, which will be carried out online, exclusively for users of legal age as stipulated in the section on conditions for participation. Italy will be excluded from the promotion.
2. START DATE AND END DATE
The Promotion will start on 25.08.2024 and end on 01.09.2024.
3. PARTICIPATION REQUIREMENTS AND PROMOTION PROCEDURE
Requirements for participation are as follows:

Any User who does not properly comply with the participation requirements described in the preceding paragraph will not be accepted, nor will any attempts that do not comply with or do not accept these terms and conditions. BLUE FACTORY TEAM S.L.U. is not responsible for any participation that is not received correctly for any reason whatsoever.
4. PROMOTION CONDITIONS AND PRIZES
The winner(s) and reserve winner(s) will be drawn at random on 02/09/2024.
The winners and reserve winners will be selected randomly via the App Sorteos platform. App Sorteos is a platform that guarantees transparent draw results. To prove this, App Sorteos issues a validity certificate for each of its prize draws, whose result is unalterable by the organiser of the draw, and which any participating user can request from the organiser.
The winner will be awarded a Mondraker Albek backpack kit including:

The winners will be announced and contacted through social media.
5. LIMITATIONS
If any of the participants are found not to have complied with the requirements set out in the Terms and Conditions, or if any of the data provided to participate is invalid, their participation will be considered null and void and they will be automatically excluded from the Promotion, forfeiting any right to receive the prizes awarded as part of this Promotion.
The prize awarded will be neither transferable nor subject to change, alteration or compensation at the Participants' request, and cannot be exchanged for any other product or money.
BLUE FACTORY TEAM SLU (MONDRAKER) reserves the right to modify, suspend or extend this Promotion if there is just cause and after prior notification in a legal manner.
Any fiscal or tax burden that the acceptance of the prize may entail for the winner, as well as any other expenses derived from the Promotion that are not expressly assumed by BLUE FACTORY TEAM SLU in these Legal Terms and Conditions, will be covered by the winner.
Participants will have a period of FIFTEEN (15) calendar days from the date of the awarding of the prize to make any justified claim. BLUE FACTORY TEAM SLU reserves the right to substitute the prize for another similar one if necessary.
6. POSTING COMMENTS OR OPINIONS
No comments or opinions whose content is considered inappropriate, offensive, abusive or discriminatory or which could infringe the rights of third parties will be allowed. Comments against an individual that violate any principle regarding the right to honour, personal and family privacy and the right to one's self-image will also not be allowed. We shall not be held responsible for any damage caused by comments made by participants in the Promotion, which may offend other participants' feelings at any time.
7. LIABILITY DISCLAIMER
We shall not be held responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect this Promotion, nor shall we be held responsible for the use made by the participant with regard to the prize obtained from this Promotion, and we do not assume any responsibility for any damage or harm of any kind that may be suffered by the Participants, winner or third parties.
We assume no responsibility in cases of force majeure or unforeseeable circumstances that may prevent the Promotion from taking place or the full or partial enjoyment of the prize. We reserve the right to cancel, modify or suspend the Promotion, including the participation website, should it not be possible to carry it out, due to fraud detected in the Promotion, technical errors or any other reason beyond the control of BLUE FACTORY TEAM SLU and which affects the normal running of the Competition.

The Promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook or Instagram and Participants hereby indemnify and hold Facebook harmless from any and all liability for any damages arising from the Promotion.

Pursuant to the provisions of the relevant data protection legislation, specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals regarding personal data processing and on the free movement of such data and repealing Directive 95/46/EC (GDPR) and Organic Act 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD), by accepting these Legal Terms and Conditions, each Participant gives their consent for the personal data provided for participation in this competition to be included in a file owned by BLUE FACTORY TEAM S.L.U., to process their participation in the competition, respond to their request, communicate the prize in the event that they are the Winner and carry out subsequent follow-up or queries for commercial purposes.
Participants guarantee their personal details are accurate and undertake to inform BLUE FACTORY TEAM S.L.U. of any changes thereto. BLUE FACTORY TEAM S.L.U. reserves the right to exclude any Participant who has provided false information from this Promotion. BLUE FACTORY TEAM S.L.U. cannot be held responsible for any unlawful theft, modification or loss of data.
Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the restriction of data processing, (iv) oppose to the processing of their data and (v) request its transferability. Notwithstanding any other administrative or judicial recourse, the Participant shall have the right to lodge a complaint with a Supervisory Authority, namely in the Member State in which they have their habitual residence, place of work or place of the alleged infringement, in case they consider that the processing of their personal data is not lawful, as well as in the event that the exercise of their rights is not satisfied.
The Supervisory Authority where the complaint has been lodged will inform the complainant of the progress and outcome thereof.

10. AMENDMENTS
We reserve the right to amend or extend these Promotional Terms and Conditions provided that it does not adversely affect or prejudice the rights of participants in the Promotion.
11. DISPUTE RESOLUTION AND APPLICABLE LAW
The Winner and the Participants expressly waive any jurisdiction that may correspond to them, and submit themselves to the Courts and Tribunals of the city of Elche (Alicante)-Spain, which will settle any disputes that may arise from this prize draw, by applying Spanish law.

BLUE FACTORY TEAM S.L.U. agrees that all information obtained in this context will be kept secret and confidential during and after the duration of this prize draw.

14. IMAGE RIGHTS ASSIGNMENT
The Winner authorises BLUE FACTORY TEAM S.L.U. to publish (online and offline), if applicable, images (photographs and/or videos) taken during the celebration of any of the activities and/or events arranged in connection with the celebration of this prize draw in which their image appears, individually or as part of a group.
The Winner agrees not to claim any compensation and/or payment, and/or reimbursement, and/or indemnification in exchange for the permission granted. This authorisation extends to the widest extent possible and therefore includes all uses that the Visual Content, or part of it, may undergo, using any medium or format and for any application or purpose, be it journalistic, editorial, advertising, decorative, etc. The authorisation is granted without any territorial or time limitation, so that said Visual Content, or part of it, may be used in all countries of the world and for an unlimited period of time.
