Legal bases for participation in the promotion - MONDRAKER TV AWARDS
1.- ORGANIZING COMPANY OF THE PROMOTION
The company BLUE FACTORY TEAM S.L.U. with address at Nicolás Copérnico n4 and identification number B-53789822 organizes the Mondraker TV Awards (hereinafter “the Promotion”) with promotional purposes, at European, USA, Canada, Central America, South America and Oceania scope , to be carried out through the internet, exclusively for users who are of legal age in accordance with what is specified in the section on conditions for participation. Italy is excluded from the promotion.
2.-STARTING AND ENDING DATES
The Promotion will start on 23/02/2024 and end on 10/03/2024.
3. -PARTICIPATION REQUIREMENTS AND HOW IT WORKS
The participation requirements are the following: Only those people who are of legal age will be able to participate.
The mechanics of the YouTube Promotion consist of:
1. Answer the survey.
2. Leave a comment or tag someone.
3. Subscribe to the Mondraker TV channel.
4.- CONDITIONS OF THE PROMOTION AND PRIZES
The winner and alternate winner will be chosen by drawing lots on 12/03/2024.
The selection of winners and alternates will be done in a randomly through the App Sorteos platform. App Sorteos is a platform which guarantees the transparency of the sweepstakes’ result and as a proof of it, it emits a certificate of validity for each one of its sweepstakes, whose result is unalterable by the organizer of the sweepstakes, and that any participating user can request to the organizer.
The winner will receive a Mondraker sweatshirt, a T-shirt, a cap and a Mondraker backpack as a prize.
5.- LIMITATIONS
If there is evidence that any of the participants do not comply with the requisites exigidos in the bases, or the given data to participate is not valid, their participation will be considered nula and they will be automatically excluded from the Promotion, loosing all their right to the prizes given in this Promotion.
The prize awarded will not be transferable or subject to change, alteration or compensation at the request of the Participants, and cannot be exchanged for any other product or money.
BLUE FACTORY TEAM SLU (MONDRAKER) reserves the right to make any change, suspend or extend this Promotion if there is just cause and prior legal notice.
Any expenses like fiscal or tax expenses, that the acceptance of the prize may entail, will be paid by the winner, as well as any other expenses derived from the promotion that is not expressly assumed by BLUE FACTORY TEAM SLU in these Legal Bases.
There is a period of FIFTEEN (15) calendar days from the date of the granting of the prize, to effect any necessary reasoned claim. BLUE FACTORY TEAM SLU reserves its right, in case of necessity, to replace the prize with another of similar characteristics.
6. - PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions which are considered inadequate, offensive, insulting or discriminatory will not be allowed or those which could violate the right of 3rd parties. Comments against an individual that violate the right to honour, personal and family privacy and self-image, are not allowed. We will not be responsible for the damage caused by the comments of the participants in the Promotion, and that at any moment could hurt the sensitivity of the participants.
7. - EXEMPTION OF RESPONSIBILITY
By way of example, but not limitation, we won’t be responsible for losses, thefts, delays or any other circumstance attributable to 3rd parties that could affect the development of this Promotion, as well as not being responsible for the use that the participant makes out of the prize obtained from this Promotion, and we will not assume any responsibility whatsoever for any damage or harm of any kind that may be suffered by the Participants, winner or 3rd parties.
We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of BLUE FACTORY TEAM SLU and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend the same, including the participation web page.
8. - FACEBOOK/INSTAGRAM [in the case of Promotion on Facebook/Instagram]
The promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook or Instagram and Participants release Facebook from any and all liability for any damages arising from the promotion.
9. - PROTECTION OF PERSONAL DATA

BLUE FACTORY TEAM S.L.U. takes the protection of privacy and your personal data very seriously. Therefore, your personal information is kept securely and treated with the utmost care.
In accordance with the provisions of the applicable regulations on data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, each Participant, with the acceptance of these Legal Bases consents that the personal data provided for participation in this contest will be incorporated into a file owned by BLUE FACTORY TEAM S. L.U. to process the participation in the contest and to communicate the prize in case of winning.
Participants guarantee that the personal data provided are truthful and are responsible for communicating to BLUE FACTORY TEAM S.L.U. any changes to them. BLUE FACTORY TEAM S.L.U. reserves the right to exclude from this promotion any Participant who has provided false information. BLUE FACTORY TEAM S.L.U. cannot be held responsible for any illicit theft, modification or loss of data.
Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of their data, (iv) oppose the processing of their data and (v) request its portability. Participants may exercise all these rights at the following email address marketing@mondraker.com indicating the reason for their request.
Without prejudice to any other administrative remedy or judicial action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not lawful, as well as in case he/she does not see his/her rights satisfied.
The Control Authority before which the complaint has been filed will inform the complainant about the course and outcome of the complaint.

10. -CHANGES
We reserve the right to modify or extend these promotional terms and conditions, to the extent that it does not prejudice or undermine the rights of the participants in the Promotion.
11.- APPLICABLE LAW AND JURISDICTION
These legal bases shall be governed in accordance with the law. The Courts and Tribunals of the city of Alicante will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
