WARRANTY CONDITIONS

All our bicycles (hereinafter, the "Product(s)") enjoy the statutory warranty conditions established in the country of purchase. These warranty conditions are therefore valid for all Mondraker Products supplied within Spanish territory and abroad.

All warranty claims for Mondraker components or original parts will be handled through an authorised Mondraker distribution point, and the original commercial invoice must be provided.

Mondraker points of sale will handle the warranty of third-party manufacturers' components, with each manufacturer being responsible for the warranty of its components used in the product.

The statutory warranty is tied to the product and the original commercial invoice.

If the Client has Consumer status, the commercial warranty will be governed by the Spanish Royal Decree 1/2007, of 16 November 2007, approving the consolidated text of the Spanish Consumer and User Protection Act, and all other complementary legislation, taking into account the amendments made to said regulation by the Spanish Royal Decree-Act 7/2021, of 27 April 2021, transposing European Directives with regard to consumer protection, in particular Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the sale of goods, amending Regulation (EU) 2017/2394 and Directive 2009/22/EC, and repealing Directive 1999/44/EC.

Bearing in mind the applicable regulations, in cases of non-conformity involving the Products, Mondraker is liable for any non-conformity existing at the time of delivery or supply and which comes to light within a period of three years after delivery, the date of delivery being understood as that indicated on the commercial invoice. As emphasised previously, possession of the commercial invoice by the Consumer will be an essential requirement to make use of the commercial warranty.

End users may only claim warranty rights with regard to Products which they acquired from and were invoiced by Mondraker directly. In the case of products acquired via an external distributor, the end users will need to send any warranty claim directly to the vendor to request the corresponding Product warranty conditions.

GENERAL WARRANTY EXCLUSIONS

1. Damage or faults caused by accident, incorrect or improper usage, abuse or negligence.

2. Wear and tear. Both on the frame and those components subject to wear and tear through usage (transmission, tyres, bearings, axles, nuts, bolts, tyres, handle grips, chain, brake shoes/pads, chain guide, hubs, etc.).

3. Faults caused by inappropriate handling or maintenance, or through the installation of parts and accessories that are not compatible or do not comply with the specific usage conditions for this model of bicycle.

4. Any manipulation, modification or structural repair, or paintwork, performed by any person or company unconnected with Mondraker, or without the authorisation of Mondraker.

The warranty governed by Consumer and User protection legislation which applies if the Purchaser has such status, only covers a malfunction caused by proven manufacturing defects, in other words non-conformities which exist at the time of delivery of the product. Nonetheless, this warranty will not be valid for external damage suffered by the Product through any cause, wear and tear through usage, or because of culpable or negligent actions by the Purchaser, nor in the case of incidents caused by force majeure. In summary, the commercial warranty will not cover any damage resulting from any cause outside the responsibility of the manufacturer, in other words Mondraker.

Nonetheless, in the event that Consumer and User protection legislation establishes presumptions regarding the existence of non-conformities at the time of delivery of the product to the end Consumer, consideration will be given to whether the presumption is compatible with the nature of the product and the type of non-conformity arising.

MONDRAKER EXTENDED WARRANTY

Mondraker bicycles are sold exclusively via its authorised distributor network, which is responsible for the servicing and maintenance of our bicycles. Mondraker frames are built in accordance with the most innovative production processes, and the most demanding quality controls. Mondraker thus offers an extended lifetime warranty for all its frames against defects in materials or manufacturing.

CONDITIONS OF THE MONDRAKER EXTENDED WARRANTY

1. The Mondraker extended warranty must be activated by means of prior online registration at www.mondraker.com within a maximum of three months of the date of purchase, and will apply only to the original purchaser. Any bicycle that does not fulfil the registration conditions will be governed by the statutory warranty conditions established in the country of purchase.

2. The extended warranty will be valid from the moment when the statutory warranty established in the country of purchase expires, covering material and manufacturing defects in the following elements manufactured by Mondraker:

- Frames (for rigid bicycles or those with front suspension)

- Front and pivot triangles (for dual suspension bicycles)

3. The extended warranty applies solely to frames acquired from the 2010 season onwards.

4. Mondraker reserves the right to repair or replace the faulty frame as a whole, or otherwise the faulty part.

5. Frames will be replaced with the same model or an equivalent from the same year, while stocks last. Once the model is out of stock, it will be replaced with a model from a subsequent year, and the aesthetic design, standards and/or model of frame may differ.

6. All extended warranty claims will be handled via an authorised Mondraker distribution point, requiring presentation of the original commercial invoice and online registration.

7. Mondraker may in any event inspect faults or defects claimed by the purchaser by any means it may see fit, including the right to conduct expert testing to accredit whether the non-conformity existed at the time of delivery of the Products.

8. The extended warranty cover will be subject to the positive resolution of the internal technical appraisal as to the nature and causes of the object of the claim.

EXCLUSIONS FROM THE MONDRAKER EXTENDED WARRANTY

Aside from the general exclusions previously indicated under the statutory warranty, the following are specifically established:

1. Those Products that do not fulfil the registration conditions and for which the statutory warranty has expired.

2. Second-hand Products, or those used for commercial purposes, such as a leasing or rental fleet, bike parks or similar.

3. Defects in the paintwork, which will be covered by the warranty established in the country of purchase.

4. Any personal damage that might result directly or indirectly during usage of the elements covered by the warranty.

5. Labour for replacement or change of parts.

It should be emphasised that each bicycle/frame has a life-cycle which will vary depending on the type of material and its construction. This life-cycle may be shortened by the form and type of use, or lack of appropriate maintenance and care. The lifetime warranty will therefore be entirely dependent on the optimal life-cycle determined by Mondraker for each specific Product.

This document contains the only valid warranty recognised by Mondraker. None of the terms and conditions granted in this warranty may be extended or amended in any way without the explicit consent of Mondraker.
